These Terms and Conditions ("Terms") govern your access to and use of the Akku OTT platform, including the website akkuott.com, mobile applications, and all related features and services (collectively, the "Platform"). The Platform is owned and operated by Genz Philam Entertainment ("Company", "we", "us", "our").

By accessing, browsing, registering on, or using the Platform, you agree to be bound by these Terms, our Privacy Policy, Refund & Cancellation Policy, and any other policies referenced on the Platform. If you do not agree, you must not use the Platform.

1. Eligibility and account

1.1. You must be at least 18 years of age or the age of legal majority in your jurisdiction to create an account and purchase a subscription. If you are below the required age, you may use the Platform only with the consent and supervision of a parent/legal guardian who accepts these Terms on your behalf.

1.2. You agree that the information you provide during registration and at all other times is true, accurate, current, and complete, and that you will keep it updated.

1.3. You are responsible for maintaining the confidentiality of your login credentials (such as OTPs, passwords) and for all activities occurring under your account. Notify us immediately if you suspect any unauthorized use of your account.

2. Services and subscription

2.1. Akku is a subscription‑based OTT streaming service that provides access to digital content, including web series, films, and other audio‑visual content ("Content").

2.2. Access to some or all Content may require a paid subscription plan. The type of Content available, the number of screens/devices, and the features offered may vary by plan.

2.3. We may offer different plans, promotional or trial offers from time to time. The details of each plan (price, duration, benefits, renewal terms, etc.) will be displayed on the Platform at the time of purchase.

2.4. We reserve the right to introduce, modify, or discontinue any subscription plan or feature at any time, with or without notice, provided that such changes do not reduce the validity of an already‑active plan within its current paid term.

3. Payments, renewals and refunds

3.1. Subscription fees are payable in advance and are inclusive/exclusive of applicable taxes and charges as indicated at the time of payment.

3.2. Payments are processed via third‑party payment service providers. By initiating a payment, you authorize the relevant provider to debit your chosen payment method.

3.3. Where auto‑renewal is enabled, your subscription may renew automatically at the end of each billing cycle using your saved payment method, unless you cancel in accordance with the instructions on the Platform.

3.4. All subscription fees are non‑refundable once the payment is successfully processed and the plan is activated, subject only to exceptions expressly stated in the Refund & Cancellation Policy or required under applicable law.

3.5. If a payment is debited but your subscription is not updated, you must contact support with complete transaction details. Any refund or adjustment in such cases will be handled as per our Refund & Cancellation Policy and the rules of banks/payment partners.

4. License and permitted use

4.1. Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, personal, non‑exclusive, non‑transferable, revocable license to access and use the Platform and view the Content solely for your personal, non‑commercial use.

4.2. You agree not to:

• Copy, reproduce, record, download (except where an official offline‑download feature is provided), distribute, or publicly display Content.
• Sell, resell, share, rent, or otherwise exploit the Platform or Content for commercial purposes.
• Bypass, remove, or tamper with any digital rights management (DRM), encryption, or security-related features.
• Use any automated tools (bots, scrapers, etc.) to access the Platform or Content.

5. User responsibilities and prohibited activities

5.1. You agree to use the Platform in compliance with all applicable laws and these Terms.

5.2. You shall not:

• Use the Platform for any unlawful, harmful, defamatory, obscene, or offensive purpose.
• Upload, transmit, or share any content that infringes the rights (including copyright, privacy, publicity, or other rights) of any third party.
• Attempt to gain unauthorized access to any portion of the Platform, other user accounts, or our systems.
• Interfere with or disrupt the operation of the Platform, servers, or networks.

5.3. You are responsible for ensuring that your internet connection, device, and software meet the minimum technical requirements for streaming.

6. Content and availability

6.1. The availability of Content on the Platform is subject to change and may vary based on your location, subscription plan, licensing rights, and other factors.

6.2. We do not guarantee that any particular title, genre, language, or feature will be available at all times. Content may be added, modified, or removed at our discretion.

6.3. Some Content may be marked with age ratings or advisories. You are responsible for ensuring that viewing complies with age‑appropriateness and local laws within your household.

7. Third‑party services and links

7.1. The Platform may integrate or provide links to third‑party sites, services, or applications (including payment processors, analytics, or content partners). These are provided for convenience and may be governed by separate terms and policies.

7.2. We do not endorse, control, or assume responsibility for any third‑party content, services, or practices.

8. Intellectual property

8.1. All rights, title, and interest in and to the Platform and Content, including but not limited to software, design, logos, trademarks, text, graphics, and audio‑visual content, are owned by or licensed to Genz Philam Entertainment and/or its licensors.

8.2. Except for the limited license granted under these Terms, no rights are transferred to you. Any unauthorized use of the Platform or Content may result in legal action.

9. Privacy

9.1. The collection, use, and sharing of your personal information are described in our Privacy Policy, which forms an integral part of these Terms.

9.2. By using the Platform, you consent to the processing of your data in accordance with the Privacy Policy.

10. Suspension and termination

10.1. We may, at our sole discretion and without prior notice, suspend or terminate your access to the Platform (in whole or in part) if:

• You violate these Terms or any applicable law.
• We are required to do so by law, court order, or regulatory authority.
• There are security, technical, or operational reasons compelling such action.

10.2. In case of termination or suspension due to your breach, you will not be entitled to any refund of fees already paid.

10.3. Sections that by their nature should survive termination (including but not limited to intellectual property, limitation of liability, and governing law) shall continue to remain in effect.

11. Disclaimers

11.1. The Platform and Content are provided on an "as is" and "as available" basis, without any warranties of any kind, whether express or implied, including, without limitation, warranties of merchantability, fitness for a particular purpose, or non‑infringement.

11.2. We do not warrant that the Platform will be uninterrupted, timely, secure, or error‑free, or that any defects will be corrected.

11.3. Streaming quality may vary based on device, location, bandwidth, and other factors outside our control.

12. Limitation of liability

12.1. To the fullest extent permitted by law, Genz Philam Entertainment and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the Platform or Content.

12.2. To the extent permitted by law, our total aggregate liability for any and all claims arising out of or in connection with the Platform shall be limited to the total subscription fees actually paid by you to us for the subscription term in which the claim arose.

13. Indemnity

13.1. You agree to indemnify, defend, and hold harmless Genz Philam Entertainment and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or related to:

• Your use of the Platform or Content.
• Your breach of these Terms or applicable laws.
• Any infringement of third‑party rights by you.

14. Changes to these Terms

14.1. We may update or modify these Terms from time to time.

14.2. The updated Terms will be posted on the Platform with a revised "Last updated" date. Your continued use of the Platform after such changes constitutes your acceptance of the updated Terms. If you do not agree with the changes, you must stop using the Platform.

15. Governing law and jurisdiction

15.1. These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of laws principles.

15.2. Subject to applicable law, you agree that the courts having jurisdiction over India shall have exclusive jurisdiction over all disputes arising out of or in connection with these Terms and your use of the Platform.
